English

Efficient regulation of the competence of supervisory institutions in addressing the smuggling of goods and currency is indispensable for the stability, prosperity, and burgeoning of the economic system. This study aims to delineate the scope and implications of the competence of supervisory bodies in this regard in Iran and certain Islamic countries (namely Turkey and Malaysia). Employing a descriptive-analytical approach and a comparative examination of relevant laws and regulations, the study demonstrates that the scopes of competence do not significantly overlap. Pursuant to the Iranian Anti-Smuggling of Goods and Currency Act, each institution bears and is bound by its prescribed duties and competences: some are charged with detection, others with the adjudication of offences, and yet others, such as the Headquarters and provincial commissions, serve as policy-making and planning authorities. This carries substantive implications for public law theory and, in particular, for economic public law in Iran. In Turkey and Malaysia, too, the scope of duties and the authority of supervisory bodies are determined by law. The findings of the study confirm that, on the one hand, the spheres of competence of these institutions complement one another, thereby imparting fluidity to administrative affairs. On the other hand, parallel oversight among them ensures the requisite control and vigilance in combating the smuggling of goods and currency, thereby contributing to the consolidation of the rule of law.
