This research, employing a comparative-analytical approach, examines the institutional status and structural challenges of the right to appeal within two key administrative justice bodies: the Iranian Administrative Court of Justice and the Turkish Council of State. The central research question concerns the extent to which these institutions effectively guarantee the right to appeal in practice, and the institutional and functional obstacles that hinder the full realization of this right. In this regard, assessing the performance of these bodies under different legal and structural conditions helps identify existing gaps and weaknesses and provides a basis for improving administrative justice systems.The primary objective of the study is to evaluate the degree to which the right to appeal is realized through the structures and functioning of these two institutions, as well as to identify the main barriers to its effective implementation. The research data were collected through the analysis of statutory provisions, judicial decisions, and institutional structures, and were examined using a descriptive-analytical method. The comparative focus is placed on the structure, jurisdiction, and level of functional independence of the two institutions.
The findings indicate that the Iranian Administrative Court of Justice is challenged by issues such as centralization, limited specialization in judicial composition, and institutional dependency. In contrast, while the Turkish Council of State benefits from greater structural independence and broader jurisdiction, it faces challenges including procedural complexity, delays in adjudication, and instances of political influence. The study underscores the necessity of structural reforms, strengthening institutional independence, and establishing preventive mechanisms to enhance the effectiveness of administrative justice systems in both jurisdictions.
