Protecting the rights of the trademark owner as a means of introducing his products and helping consumers to reach the products they want is an undeniable necessity that becomes more important when undertakings enter the World Wide Web. The virtual nature and technical subtleties of the World Wide Web, in addition to facilitating transactions, have made it an arena for trademark infringement in various and complex ways. Although confusing use causes trademark infringement, determining whether a particular use of a trademark on the World Wide Web is confusing and therefore infringing requires careful observation and awareness of the characteristics of this space. In comparative jurisprudence, many cases of trademark use on the World Wide Web have been declared infringing and therefore prohibited, while there is disagreement about some others. A study of the laws of the Islamic countries of Iran and Egypt shows the capability of these laws to meet the needs of trade on the World Wide Web, using the lessons of comparative jurisprudence. At the same time, it seems necessary to clarify the cases of infringement and to make the laws of the two countries more transparent. The law of Iraq in this regard needs deeper transformation and reform.
