Terrorism is a criminal act based on acts of violence, murder, creating fear and terror, and displacing innocent people, and what is accompanied by encroachment on the dignity of others, their freedoms, and similar cases. The crime of terrorism is another form of the crimes of war and corruption on earth for which Islam has prescribed the most severe punishment, which is: murder, hanging, amputation of the right hand and left foot, and exile or imprisonment. Considering the spread of terror, which is one of the examples of violence in recent years in many countries, the present article has examined the crimes of terrorism in the laws of Iran and Iraq in a descriptive and analytical manner. Concepts such as assassination, murder, corruption on earth, and war are synonymous with acts of terrorism, that is, in practice and examples they are similar, which are factors that threaten the peace and security of society and the system and create fear and terror among people. But in Arabic, terrorism is the same meaning. Although the term "corruption on earth" is more expressive than the term "terrorism". All legal cases included in the Iraqi Anti-Terrorism Law No. (13) of 2005 are subject to the concept that the perpetrator is entitled to the punishment stated in verse 33 of Surah Al-Ma'idah. Both the crimes of terrorism and "harabeh" rely on violence, force, and the creation of terror and fear among people and society by using various types of weapons and threats. In Iranian law, which is derived from jurisprudence, the punishments of "harabeh" are also included for the crime of terrorism, although sometimes it is mixed with the crimes of "bughi" (political crimes and rebellion against the Islamic rule system), which is said to be "harabeh" connected to "bughi".
