The 2014 Tunisian constitution established a mixed political regime with the aim of balancing powers in by stipulating the principle of separation of powers. However, with the amendment of this act in 2022, many of the powers of the powers were revoked and the total powers of the president were added, including the presidency and supervision of the cabinet, the regulation and formulation of cabinet programs, the authority to dissolve parliament, and the prominent role of the president in the judiciary, which has raised important controversies in the field of constitutional law, especially in relation to the balance of powers and the way to establish a balance between the three branches of government. This article, with the aim of analytically examining the innovations of the latest Tunisian constitution and compared to the 2014 constitution, seeks to answer the question: Has the Tunisian political regime moved towards a balance of powers or authoritarianism after the revision of the constitution in 2022 and the change in the powers of the president? The article was conducted with a qualitative research method and a descriptive and analytical-comparative approach. The most important findings of the research are that the 2022 Tunisian Constitution has departed from the balance of powers, although it has not transformed into a presidential regime due to its specific socio-political context. In this unclear context, the Tunisian Constitution has combined the separation of powers with the complete supremacy of the executive branch to the point of presidential dictatorship, leading to the “return of authoritarianism” or “personalized presidentialism.”
