Research on the approaches to the evolution of personal status laws in Islamic countries not only contributes to a better understanding of the historical and legal processes of this transformation but can also provide solutions for reconciling tradition with contemporary issues. This is essential for ensuring social justice and addressing the needs of Islamic societies. The main research question is: What are the dominant approaches governing the evolution of personal status laws in Islamic countries, and through what mechanisms have they been implemented? It appears that the dominant approaches to the transformation of personal status systems in most Islamic countries align with global convergence and are influenced by international laws and overarching documents. Therefore, this study, using a descriptive-analytical method and aiming to examine the approaches to legal evolution in the personal status systems of Islamic countries, demonstrates that personal status laws in Islamic countries have been influenced by human rights developments stemming from international laws and documents. As a result of these changes, parts of their civil laws have adopted models from Western examples. However, despite this influence, there is a noticeable tendency in some of these countries to return to authentic Islamic thought and the supremacy of its legal principles. احوال شخصیه به‌عنوان یکی از مهم‌ترین شاخه‌های حقوق خصوصی، در کشورهای اسلامی تحت تأثیر عمیق شریعت اسلامی و تحولات اجتماعی قرار دارد. تحقیق درباره رویکرد تحول احوال شخصیه کشورهای اسلامی نه‌تنها به فهم بهتر از روندهای تاریخی و حقوقی این تحول کمک می‌کند، بلکه می‌تواند راهکارهایی برای تطبیق میان سنت و مسائل نو ارائه دهد. چنانکه برای تأمین عدالت اجتماعی و پاسخگویی به نیازهای جوامع اسلامی ضروری است. مسئله اصلی مورد پژوهش این است که رویکردهای حاکم بر تحولات احوال شخصیه کشورهای اسلامی، به چه صورت بوده و با چه سازوکاری انجام‌شده است؟ به نظر می‌رسد رویکردهای حاکم بر تحول نظام‌های احوال شخصیه در بیشتر کشورهای اسلامی در راستای همگرایی جهانی و متأثر از قوانین و اسناد بالادستی بین‌المللی می‌باشد. از این رو پژوهش حاضر با روش توصیفی-تحلیلی و با هدف بررسی رویکردهای تحول در نظام احوال شخصیه کشورهای اسلامی، نشان می‌دهد که احوال شخصیه در کشورهای اسلامی با توجه به تحولات حقوق بشری متأثر از قوانین و اسناد بین‌المللی است و درنتیجه تحولات صورت گرفته، بخش‌هایی از قوانین مدنی آنان، از نمونه‌های غربی الگو گرفته؛ اما به‌رغم این تأثّر، تمایل به بازگشت به اندیشه اصیل اسلامی و حاکمیت قوانین حقوقی آن در برخی از کشورهای مزبور دیده می‌شود. https://lcs.ilam.ac.ir/article_729854_6a138b14fcec609eba9f558caeda24ca.pdf
